                C. Release & Waiver re: Videotaping

    RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT FOR VIDEO TAPING PROGRAM

     

                With full knowledge of the risks, I voluntarily enter into this release and indemnification 

    agreement to avoid any liability to Williamson County or Williamson County Library should I

    use any individual’s, including a minor child’s, name, photograph or likeness from any injury or

    damages resulting directly or indirectly from the use of the name, photograph, or image, or from

    participating in my program.

     

    1.         I understand that Tenn. Code Ann. § 47-25-1105(a), prohibits the unauthorized use or

    infringement upon “another individual's name, photograph, or likeness in any medium, as an item

    of commerce for purposes of advertising products, merchandise, goods, or services, or for

    purposes of fund raising, solicitation of donations, purchases of products, merchandise, goods, or

    services, without such individual's prior consent, or, in the case of a minor, the prior consent of

    such minor's parent or legal guardian,....”

     

    2.          I understand that Williamson County, Williamson County Public Library, their agents

    and employees, and any volunteers present at my Program, are not responsible for any

    unauthorized use of an individual’s name, photograph or likeness, or any injury, loss or damage

    relating, either directly or indirectly from the use of the individual’s, including that of a minor's,

    name, photograph, or likeness.

     

    3.         I agree to hold harmless, indemnify and release Williamson County, Williamson County

    Public Library, their agents and employees, and any volunteer organizing or participating in the

    Program on behalf of Williamson County Public Library, from any liability for any injury or

    damage sustained as a result of the use of any name, photograph, or likeness of any individual,

    including minor children, or any other injury or damage associated with the program.

     

    4.          I understand that this agreement shall be legally binding on the undersigned, his heirs,

    executors, administrators, successors and assigns.

      I HAVE READ AND UNDERSTAND THE ABOVE RELEASE AND WAIVER OF LIABILITY AND INDEMNITY AGREEMENT AND I AGREE TO BE LEGALLY BOUND BY ALL TERMS OF SAID AGREEMENT.  I UNDERSTAND THAT I HAVE THE RIGHT TO CONSULT LEGAL COUNSEL BEFORE SIGNING THIS AGREEMENT AND HAVE EITHER DONE SO OR WAIVE MY RIGHT TO DO SO.

  6. Electronic Signature Agreement
    By checking the "I agree" box below, you agree and acknowledge that 1) your application will not be signed in the sense of a traditional paper document, 2) by signing in this alternate manner, you authorize your electronic signature to be valid and binding upon you to the same force and effect as a handwritten signature, and 3) you may still be required to provide a traditional signature at a later date.
